Client was stopped for speeding and eventually arrested for felony possession of marijuana and possession of a firearm during the commission of a felony, along with a slew of traffic offenses. The officer weighed the drugs on the scene at 14 grams, a misdemeanor, but charged the client with more than double that amount at the felony level. The officer failed to come to court and failed to send the alleged marijuana to the lab for testing to verify the amount and that it was actually marijuana. I presented proof in defense of the traffic offenses and challenged the sufficiency of the state’s case given the failings and discrepancies in the officer’s actions. I also argued the fact that my client traveled a long distance to be present while the officer refused to attend the hearing. All charges were dismissed and I also got all of the records expunged as well.
